This is a hybrid position requiring 3 days onsite in Brentwood, TN.
The Assistant General Counsel, Labor and Employment provides legal advice related to employment and labor relations matters to all business units of the company. Oversees management of related compliance audits and litigation pertaining to employment and collaborates and supports the management of non-employment related matters.
Essential Functions:
The incumbent should be able to perform all of the following functions at a pace and level of performance consistent with the job performance requirements.
- Provides legal advice and guidance to corporate and facility management and human resources staff regarding labor and employment matters.
- Provides legal advice and guidance in the development and drafting of policies and procedures for compliance with relevant employment law and contract requirements.
- Provides legal advice and guidance in the resolution of significant employee grievances.
- Provides legal advice and guidance to HR Compliance department regarding all employment law matters.
- Provides legal interpretation and guidance to facility staff in the applicability of public records laws. Responds appropriately and accurately to public records requests.
- Maintains professional competency through continuing legal education and educational seminars relative to employment law.
- Manages outside counsel in employment litigation, manages and/or drafts company response to charges of discrimination filed with state and federal administrative agencies, including claims related to wage and hour issues, USERRA matters, and claims related to workplace safety and health issues.
- In cooperation with HR and the HR Compliance Department, manages and provides advice and legal representation throughout all phases of compliance audits related to federal and state EEO, affirmative action, and wage and hour laws.
- In cooperation with the Ethics and Compliance Office and the Investigations Counsel, participates in the investigation, review, and resolution of allegations of sexual harassment and other workplace conduct in violation of company policy.
- Provides and/or assists with employment-related training to employees at all levels and in all facilities as needed.
- Evaluates complexity and impact of pending employment law matters and engages appropriate outside legal counsel as necessary and appropriate.
- In coordination with other legal and operational stakeholders, collaborates and supports the management of non-employment claims and related litigation, including premises liability, personal injury, civil rights, or commercial disputes as directed.
- Domestic U.S travel is required.
Qualifications:
- Graduate from an accredited college or university with a Doctor of Jurisprudence degree and admission and/or eligibility for admission to the practice of law before the Courts of the State of Tennessee required.
- 5+years of employment and/or labor law experience required.
- Must demonstrate ability to analyze complex legal issues and documents.
- Must possess strong written and verbal communication skills and have the ability to effectively advocate or defend legal positions to constituent groups at all levels of the organization.
- Proficiency in Microsoft 365 applications is required.
