The Assistant General Counsel is responsible for performing a full range of legal services in support of A Local Management Entity-Managed Care Organization as a member of A Local Management Entity-Managed Care Organization Office of Legal and Public Affairs.

The selected candidate may have option to work a hybrid schedule, subject to management approval.

Responsibilities & Duties:
A Local Management Entity-Managed Care Organization seeks a NC-licensed attorney with the skills and experience necessary to perform any of the responsibilities and duties set forth below. For this position, management prefers an attorney with experience in 1. drafting, reviewing, and negotiating administrative contracts and 2. independently managing litigation and court appearances in Mecklenburg County Juvenile, District and Superior Courts.

General Legal Support
  • Provide legal support to A Local Management Entity-Managed Care Organization in all contracts necessary to A Local Management Entity-Managed Care Organization functions including drafting, negotiating and advising on contracts such as Medicaid and State contracts, provider contracts, delegated services agreements, administrative contracts and others. Primary emphasis will be on all aspects of contract compliance with the North Carolina Medicaid 1115 and 1915 b/c waiver.
  • Mitigation of legal risk to the organization by providing sound and competent day to day legal advice under the supervision of the Deputy General Counsel in a variety of legal areas pertinent to A Local Management Entity-Managed Care Organization's mission.
  • Establish stable and positive working relationships with assigned A Local Management Entity-Managed Care Organization departments to facilitate access to legal advice, and to review and advise on needed changes to agency and departmental practices.
  • Create training resources for A Local Management Entity-Managed Care Organization staff and external partners as needed. May be required to make presentations and trainings to employee groups, provider and/or member groups and other external stakeholders such as advocacy and judicial organizations. Represent A Local Management Entity-Managed Care Organization's legal interests by participating in collaborations with external stakeholders such as judicial and healthcare bodies, in support of consumer relations.
  • Ability to perform legal research and analysis, gather and analyze information, write legal memos and papers, draft responses, review investigative reports, processes and documentation in accordance with initial guidance as to methods of approach, source materials available. Ability to understand and interpret constitutional provisions, statutes, administrative regulations, and precedents; ability to analyze facts, evidence, and legal instruments; ability to express conclusions and arguments clearly and logically in oral and written form.

Make complex legal decisions that have impacts agency-wide. Work dynamic, fast-paced, and is for the most part done autonomously; therefore the attorney must have the ability to work independently and be dynamic.
  • Represent and defend A Local Management Entity-Managed Care Organization in all stages of legal challenges including quasi-judicial settings such as the Office of Administrative Hearings, EEOC and courts of competent jurisdiction, such as State and Federal courts of both original and appellate jurisdiction. Possess and maintain a working knowledge of governmental and public sector law, and Medicaid and other health regulations. Knowledge of judicial and quasi-judicial procedures regarding the rules of evidence;
  • Review and determine the merits of a case; develop a case strategy, perform research to prepare for litigation, and conduct civil and administrative litigation. Legal research activities involve the review of the case, determination of its merits and points of law, analysis of pertinent statutory and case law, analysis of administrative and procedural rules, and development of legal arguments.
  • Communicate with others outside of the organization, exercising participative management and negotiation skills that support agency strategy and organizational goals.

Required Experience:
Juris Doctorate from an ABA-accredited law school and licensed to practice law in NC.

At least 5 years of applicable legal experience. Legal experience representing state agencies or local governments; Knowledge and experience with State and Federal laws, rules and regulations governing Medicaid, Healthcare, Managed Care operations and/or publicly-funded healthcare services.
