- Manages the City of Hialeah leases, both in a landlord and/or tenant capacity. Manages the activities of, and plans improvements as well as public partnerships for City-owned properties. Coordinates with other departments to develop strategic plans and Public Private Partnership (P3s) opportunities for City-owned properties that will maximize benefits to the residents of Hialeah, and maximize City revenues. Responsible for managing the City's real estate assets and working with the City's Purchasing and Finance Divisions, and the Office of the City Attorney as to all legal matters and issues, to ensure all necessary procedures are followed to ensure compliance with Federal, State and Local laws, codes, rules, policies, regulations. Coordinates the negotiation of contractual services and performs such operations directly; administers and promulgates municipal policies and regulations pertaining to the acquisition, development, management and disposition of City-owned property, subject to legal review and legislative approvals as required; directs efforts to maximize the revenue potential and community use of municipally owned assets; negotiates property leases, management agreements, revocable permits, and easements overseen by the City Attorney or designee; negotiates the sale and acquisition of real property; leases, management agreements and revocable permits and the maintenance of all property files and inventory; facilitates short and long range planning for the department; coordinates with external and internal agencies as it pertains to deed and funding related restrictions, as well as all permitting aspects; and shall perform such other duties as the Mayor and City Attorney may prescribe from time to time. Works under the supervision of the City Attorney and reports to the City Attorney or designee. All actions and duties subject to compliance with applicable laws, codes, rules and regulations.
- The following illustrates examples of some of the essential duties and responsibilities of the Assistant City Attorney / Real Estate and Asset Manager. There may be other essential functions, not listed below, in order to accomplish the tasks as presented by the Supervisor.
- Lead or support strategic project management, ensuring deliverable quality and timeliness, and stakeholder management; develop, refine and complete various projects; At the direction of the City Attorney, communicate project status to City departments, Mayor, and the City Council.
- Manage the City's real estate portfolio.
- Develop policies and procedures for real estate acquisition and disposition and for management of leases and the City's real estate portfolio subject to City Charter/Code and the approval by the City Attorney; provide inventory and information services on City owned real estate.
- Analyze real estate proposals and negotiate lease terms for City owned assets.
- Act as City liaison for real estate activities with other agencies such as Miami-Dade County, Miami-Dade County Public Schools, Florida Department of Transportation, other governmental entities, and economists and appraisers.
- Review unsolicited proposals and P3s involving City owned real estate.
- Manage the tangible assets of the City and work with the County and State to ensure tax compliance for all transactions.
- Provide legal counsel to Building and Zoning Divisions pertaining to all aspects of community development, including any board of such department that makes recommendations to the City Council.
- Draft , prepare and issue or cause to be noticed and issued Requests for Proposals (RFPs) and similar competitive solicitation documents involving City's property.

Knowledge, Skills, and Abilities:
- Considerable knowledge of Federal, State, and municipal civil laws and of constitutional law affecting municipal government.
- Extensive knowledge of current methodologies, practices, procedures, and theories in the fields of appraisals, contract management, economic/community development, property management, and real estate
- Court procedures and rules of evidence, legal research procedures and forms.
- Ability to acquire thorough knowledge of the City Charter and ordinances and to apply legal knowledge to varied problems.
- Analyze and prepare a wide variety of legal documents.
- Analyze and brief court decisions, provisions of City ordinances, Federal and State statutes.
- Draft legal memorandums, ordinances, and resolutions.
- Reconcile conflicting provisions of laws and court decisions.
- Express ideas clearly and concisely, orally and in writing; use excellent English.

Physical Requirements:

- Physical capability to effectively use and operate various items of office equipment; such as but not limited to a personal computer, calculator, copier and fax machines.
- Work is performed indoors within a quiet to moderately noisy environment.
- Must be able to lift, carry and or push articles weighing up to 20 lbs.
Minimum Training and Experience:
- Bachelor's degree in finance, economics, real estate or related area. Significant progressively responsible experience handling real estate transactions, as well as negotiating and maintaining leases.
- Juris Doctorate from an accredited law school and member in good standing of the Florida Bar for 5 years in order to serve as Assistant City Attorney.
- English & Spanish Speaking preferred.
- State of Florida Licensed Real Estate Broker and/or professional designation(s) such as Real Property Administrator (RPA), Certified Property Manager (CPM), Master of Corporate Real Estate (MCR) or Certified Commercial Investment Member (CCIM) preferred.
