The Assistant City Attorney will support the Senior Assistant City Attorney within the Litigation Division, collaborating closely with the City Attorney's Office and the Claims Division. This role involves representing the City in various civil matters, including proceedings in both state and federal courts. This role includes all aspects of litigation, from pre-litigation investigation, litigation discovery, and motion practice to trials, appeals, or special actions.

Key Responsibilities:
  • Investigating notices of claims and conducting pre-litigation case analysis, interviews, and evaluations.
  • Conducting legal research in a wide variety of areas of civil law and learning new areas of law quickly and effectively.
  • Preparing written legal analyses and memoranda, motions, pleadings, briefs and other court filings.
  • Managing cases in all stages of litigation from pre-litigation to discovery and trial.
  • Preparing witnesses for depositions, trials, and administrative hearings.
  • Taking and defending depositions and other sworn testimony.
  • Conducting oral argument on motions, briefs, and similar items in state and federal court, including on appeal.
  • Appearing as first chair or co-counsel in civil hearings or trials in state and federal court.
  • Advising the Claims Coordinator and City Attorney's Office on liability questions, claim evaluations, and similar matters.

This position requires strong writing and oral advocacy skills, sound legal judgment, and the ability to work collaboratively across departments in a fast-paced environment for a large and complex client.

The ideal candidate for this position will have:
  • Civil litigation experience for a government client, including motion practice and depositions.
  • Oral advocacy experience, including at hearings or trials in state or federal court.
  • Appellate experience in state or federal court.
  • Experience with one or more of the following areas of law: personal injury/wrongful death; tax; property; land use; eminent domain; contracts; administrative/regulatory; constitutional, including section 1983 claims; elections; public records; open meeting; and construction.

Minimum Requirements:
Education:
Juris Doctorate from an American Bar Association (ABA) accredited law school.

Experience:
Minimum of six years related experience.

Licenses and Certifications:
  • Membership in good standing in the State Bar of Arizona.
  • Admission to the Ninth Circuit Court of Appeals within three months of hire.
  • Admission to the US District Court for the District of Arizona within three months of hire.

Preferred/Desirable Qualifications:

Experience in a municipal or government setting.
