Under general direction of the Deputy Director, the Assistant Chief Counsel (ACC) is responsible for ensuring public access to current and proposed state regulations and providing the public with a meaningful opportunity to comment on proposed regulations by ensuring that an agency considers those comments when it develops regulations, supervises the legal staff to improve the quality of regulations of the State; performs the most sensitive and complex legal work, as well as supervises the legal reviews of others for compliance with procedures and standards set forth in the Administrative Procedure Act (APA) (Gov. Code, sec. 11340 et seq.). In addition, the ACC oversees litigation, legislation and the issuance of determinations concerning challenged underground regulations. The ACC also acts as the administrative head of the agency when the Director and Deputy Director are unavailable.
This position is designated under the Conflict of Interest Code. The position is responsible for making or participating in the making of governmental decisions that may potentially have a material effect on personal financial interests. The appointee is required to complete Form 700 within 30 days of appointment. Failure to comply with the Conflict of Interest Code requirements may void the appointment.
