The Attorney General and the Department of Justice represent the people of New Mexico and the interests of the State. With respect to criminal prosecution, the New Mexico Department of Justice works in tandem with New Mexico's 14 district attorneys and other local, state and federal law enforcement authorities to bring criminals to justice and protect the interests of crime victims and the people. The New Mexico Department of Justice, Special Prosecutions Division prosecutes various crimes throughout the state of New Mexico, including violent crimes, human trafficking, white collar crimes, organized retail crimes, and crimes against children. Prosecutors in the division are also involved in drafting and analyzing legislation and providing training statewide to prosecutor and law enforcement officers. National training opportunities exist for more and less experienced prosecutors.

Why does the job exist?
Attorneys in the Special Prosecution Division establish a standard of excellence in the prosecution of various crimes throughout the State of New Mexico. Attorneys handle these matters from the intake/charging phase all the way through trial. Attorneys within the division carry a manageable caseload that allows time for collaboration with other attorneys in the division, consultation with experts, and trial preparation using expert jury consultants.

How does it get done?
Key responsibilities are to prosecute criminal cases from screening to final disposition. This includes recommending charging decisions, motions practice, criminal litigation and trial. Prosecuting attorneys are expected to collaborate with law enforcement agencies throughout the state as well as Department of Justice Special Agents. They are expected to travel as needed within the state for pretrial interviews, courtroom appearances and other matters. Prosecuting attorneys also have the opportunity to give and participate in specialized trainings related to criminal prosecution.

Who are the customers?
Prosecuting attorneys at the NMDOJ represent the State in criminal matters. They must also ensure the protection of the rights of the crime victims.

Ideal Candidate:
The ideal candidate is an attorney in good standing, licensed in the state of New Mexico with a strong background in criminal law and procedure including strong litigation skills, writing skills, and extensive criminal trial experience.

Minimum Qualification:
Juris Doctorate degree from an accredited school of law and two (2) years of experience in the practice of law. Must be licensed as an attorney by the Supreme Court of New Mexico or qualified to apply for limited practice license (Rules 15-301.1 and 15-301.2 NMRA). Employment Requirements:
Must possess and maintain a current Defensive Driving Course Certificate from the State of New Mexico or must pass and receive Defensive Driving Course Certification as a condition of continued employment as some statewide travel maybe required. Employment is subject to criminal background check and is conditional pending results of criminal background check. Be of good moral character and not have been convicted of a felony offense by a court of this state, any other state or the United States.

Working Conditions:
Working conditions are an office setting with exposure to visual/video display terminal. Hybrid work from home options are available. Some exposure to sensitive visual media may be required. Courtroom appearances are frequent.
