Job Description:Assistant Attorney General - Public Protection and Fraud
The Public Protection & Fraud Division of the Utah Attorney General's Office has an opening for a full-time attorney in its Real Estate and Securities section, focused on the enforcement of laws related to real estate, mortgages, and appraisals; securities; consumer protection; and professional licensing. Our division represents the Department of Commerce in civil actions before state and federal courts as well as in administrative proceedings before boards, commissions, and administrative law judges.
Our team operates in the fast-paced, meaningful, and challenging world of affirmative enforcement, and works with federal and state partners to accomplish great results. Our work includes litigating to stop the opioid crisis; challenging unaffordable insulin prices; suing Ticketmaster over its sales practices; holding social media companies accountable for harms to kids; driving Pornhub to bring down non-consensual and child pornography; helping to discipline professionals who transgress the laws of their licenses; combatting abuse against elders and other vulnerable populations; stopping false advertising; and halting Ponzi schemes.
The available position will focus primarily on stopping fraud and unprofessional conduct in the real estate industry while representing the Utah Division of Real Estate. The attorney will advise clients, investigate and develop cases, litigate, and draft statutes and administrative rules. Although the position will focus on real estate issues, an interest in securities law and other aspects of white-collar fraud is appreciated, as is a creative mind and dogged spirit, as we work with our partners to protect the health, safety, and economic security of the people of Utah.
Our Division's mission is to make Utah's marketplace safe and fair by combating unlawful commercial activities and building trust in our economic landscape. We are committed to serving the public, and we work collaboratively with our client agencies to:
- oversee the professional standards for real estate brokers, appraisers, and mortgage lenders;
- stop the unlicensed and fraudulent sales of securities and commodities;
- regulate the professional standards for over thirty professions, from midwives to funeral services and nearly everything in between; and
- protect consumers from deceptive business practices.
Responsibilities:
- Conduct all levels of civil litigation from initial intake through investigation, pleadings, expert and fact discovery, trial, appeal, post-judgment, and collection efforts.
- Handle high-profile and complex cases.
- Build and maintain positive relationships with clients and colleagues.
- Communicate, write, and listen well.
- Advise clients and colleagues on complex issues of law and regulation.
- Manage and guide paralegals and staff.
- Learn new skills and practice areas as needed.
- Potential travel to various court locations and stay overnight in and outside of Utah.

- A Juris Doctorate is required.
- Preference will be given to candidates with over five years of relevant post-law school experience.

- This position is based in Salt Lake City and is not suitable for a candidate seeking remote work.
- Risks found in the typical office setting, which is adequately lighted, heated, and ventilated, and requires a candidate to engage in, for example, safe use of office equipment, avoiding trips and falls, observing fire regulations, etc.
- Typically, the employee may sit comfortably to perform the work; but there may be some walking, standing, bending, carrying light items; driving a car, etc. Special physical demands are not required to perform the work.

- Attorneys are hired at a salary consistent with their experience-level-peers in non-supervisory positions. For the purpose of starting salary calculation, experience level isbased on initial Bar admittance year, less any years not practicing law.
