Description:

The Office of the New York State Attorney General's Taxpayer Protection Bureau (https://ag.ny.gov/about/about-office/economic-justice-division#taxpayer-protection) (TPB) is seeking an experienced litigator who is entrepreneurial, creative, and motivated to lead and pursue complex civil investigations and litigation involving fraud committed against New York state and its local governments.

TPB is a close-knit, collegial team doing complex and high-value work for the state by handling non-Medicaid whistleblower cases and investigations under the New York False Claims Act. Frauds investigated by TPB include large tax frauds; frauds involving government contracts for goods or services; frauds involving government investments; and frauds involving government-funded social programs. TPB's investigations regularly involve coordination with other state and federal agencies and with whistleblowers, who file qui tam actions under the federal and New York False Claims Acts.

Over the past decade, TPB has successfully recovered nearly $800 million for New York taxpayers. Matters of note include a settlement with a travel booking company for tax evasion, a settlement with a major art auction house for fraudulently helping its customers avoid sales tax, a settlement with a fraudulent gift card consulting company, a $105 million settlement with a hedge fund manager who evaded New York taxes, and a settlement with a construction company that violated New York state diversity requirements for public projects (https://ag.ny.gov/press-release/2024/attorney-general-james-and-acting-dtf-commissioner-hiller-secure-more-6-million) by falsely certifying its use of women and minority owned businesses (MWBEs).

The bureau provides an excellent professional platform for attorneys to develop and refine their first-chair professional skills in both investigations and enforcement actions. Such skills include taking testimony, managing evidence, performing case analysis, interacting directly with opposing counsel, settlement negotiation, motion practice, and other oral and written advocacy.

Qualifications:
  • At least three (3) years of relevant post-graduate legal experience is required; however, TPB will also consider well-qualified applicants who have fewer years of post-graduate experience;
  • Experience in complex civil litigation and/or white-collar investigations;
  • Familiarity with practice in both federal and New York state courts;
  • Strong writing, research, analytical, teamwork, and organizational skills; and
  • Experience with the False Claims Act and/or tax matters is a plus.
