The Starting Salary for This Position Is Limited to $87,849 to $103,184. Salary Offers for The Selected Candidate Are Based on The Candidate's Education and Experience Related to The Position, as Well as Our Agency Budget and Equity.
The Tort Claims Section of The N.C. Department of Justice Represents the Various State Agencies Subject to Suit Pursuant to N.C. Gen. Stat. 143-291, Et Seq.
The Attorney General Represents All Departments, Institutions and Agencies of The State in Claims Brought Against Them Under the Tort Claims Act, G.S. 143-291, Et Seq. This Attorney Acts as Defense Counsel for Dac, Dps in Legal Actions Brought Pursuant to The Tort Claims Act, N.C.G.S. 143-291, Et Seq.
This Position Will Respond on An as Needed Basis to Queries from The Client Agency Regarding Negligence and Risk Management Issues. the Attorney Will Speak at Conferences and Teach at Workshops for Individual Clients, upon Request. the Attorney Will Represent the State Before the Court of Appeals and Supreme Court, in Both Tort Claims Actions and Criminal Actions.
Responsibilities and Duties:
- This Attorney Will Represent Dac and Dps in All Litigation Matters that Arise Under N.C.G.S. 143-291. These Responsibilities Include Investigation of Claims, Drafting of Responsive Pleadings, Conducting Discovery, Attendance at All Pretrial Hearings, Trials, and Appellate Events. the Attorney Will Be Required to Travel to Those Locations Where the Various Litigation Endeavors Are Conducted.
- Client Outreach, Responding on An As-Needed Basis to Queries from The Client Agencies Regarding Negligence and Risk Management Issues. the Attorney Will Also Speak at Conferences and Teach at Workshops for Individual Clients, upon Request.
- Representation of The State Before the Court of Appeals and Supreme Court in Criminal Appellate Matters.
This Position Requires Travel and Overnight Travel.

Knowledge, Skills and Abilities / Competencies:
- The Qualified Applicant Will Have Extensive and Expert Knowledge of The N.C. Rules of Civil Procedure, the N.C. Rules of Evidence, the Tort Claims Act, the N.C. Rules of Appellate Procedure, and Any Other Related Statute, Regulation or Code.
- The Qualified Applicant Will Be Well-Versed Legal Research and Writing, Oral Advocacy, and Overall Litigation Strategies.
Minimum Education and Experience Requirements:
Licensed to Practice Law by The North Carolina State Bar and Three Years of Progressively Responsible Professional Legal Experience.
