Please note: The position requires knowledge of Labor Law, Workers' Compensation Laws, negligence, product liability laws, interpretation of contracts and insurance policies, analysis of legal issues, researching statutes, court decisions, appellate opinions, and other sources for use in recommendations and/or the handling of cases.
Minimum Qualifications
- Coordinate with outside counsel in handling the defense of NYSIF policyholders/employers in third-party actions involving injuries to employees.
- Responsible for case analysis, reserve setting and adjustment, calculations of liens under Workers Compensation Law 29, active monitoring and coordination with outside counsel, development/oversight of litigation strategies relative to the personal injury action, resolution of cases, and review/approval of all invoices from legal vendors.
- Participation in court conferences, mediations, arbitrations, and other settings regarding the potential settlement of actions, as necessary.
- Active communications and coordination with policyholders, safety group representatives, brokers-insured representatives, insurance carriers, NYSIF Claims Department personnel and Third-Party Legal Division staff.
- Handle the action from assignment until final resolution of the case.
- Update Claims Center, FileMaker Pro and other databases, as necessary.

- To Assistant Attorney 2 (Grade 20): Admission to NYS Bar.
- To Assistant Attorney 3 (Grade 22): Admission to the NYS Bar* and 12 months of subsequent satisfactory legal experience.
- To Senior Attorney (Grade 25): Admission to the NYS Bar* and 24 months of subsequent satisfactory legal experience.
For competitive appointment:
- To Senior Attorney (Grade 25):12 months as an Assistant Attorney 3; OROne year of permanent, competitive class service as a Senior Attorney.
- Transfer: Current New York State employee with one year of permanent competitive
- class service in a title eligible for transfer under Section 52.6 of Civil Service Law. Appointments via transfer must not result in a second, consecutive transfer with an advancement of more than two S-grades or one M-grade.
- Admission to the New York State Bar and current registration to practice law in New York State is necessary for continued employment. Disbarment or loss of registration shall result in termination or suspension of employment.

For candidates that are current NYS employees, salaries are calculated in accordance with NYS Civil Service Law, OSC Payroll rules and regulations, and negotiated union contracts.

For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply.
At a future date, it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all the same rights and privileges of competitive class employees of New York State.
