Duties and Responsibilities:
The Senior eDiscovery Attorney is responsible for providing expertise and leadership with respect to eDiscovery aspects of cases, including:
  • Working with case teams and clients to plan and execute eDiscovery strategy.
  • Leading or co-leading custodian interviews, custodian selection, and collection scope and process determination.
  • Supporting and/or leading case teams in responses to opposing parties and government agencies.
  • Defending eDiscovery processes and addresses questions in the course of representation.
  • Assisting eDiscovery Attorneys by providing expertise and guidance, and by advising clients or consulting with opposing party as needed.
  • Developing and negotiating search protocols, search terms, and scope agreements with opposing parties.
  • Drafting and negotiating discovery orders (ESI Protocols, Search Disclosures, Confidentiality Orders, Discovery Timelines and Scope Agreements) with opposing parties and joint defense groups.
  • Participating in and/or lead meet and confers with opposing parties/agencies on discovery related topics.
  • Drafting and/or editing Responses and Objections to RFPs and subpoenas.
  • Developing collection, review and production plans to comply with Rules and Orders.
  • Researching case law in various jurisdictions to support discovery motion practice.
  • Providing guidance on Federal Rules as it relates to discovery.
  • Working with vendors and clients on collections of emerging data sources.
  • Drafting or editing discovery correspondence with opposing parties and government agencies.
  • Responsible for educating Axinn's attorneys, including the eDiscovery group, about eDiscovery case law, rules, and other areas relating to eDiscovery.
  • Staying up to date on new trends and best practices in eDiscovery.
  • Working on special projects as the needs of the eDiscovery group or firm management require.

The Senior eDiscovery Attorney may also act as an eDiscovery Attorney on certain case teams, which includes the following:
  • Managing documents reviews, privilege logging, and quality control.
  • Supervising contract attorneys.
  • Preparing production sets for releasing to opposing parties.
  • Assisting with eDiscovery budgeting and vendor selection.
  • Negotiating rates and terms with eDiscovery vendors.
  • Assisting with advocacy review, deposition preparation, and other document-related support for assigned cases as needed.

Minimal travel is required and more than 35 hours per week is often needed to perform the essential duties of the position.

Education, Experience, and Skills Required:
  • JD and at least 10 years of eDiscovery experience.
  • Proven track record in managing eDiscovery projects.
  • Thorough knowledge of the eDiscovery lifecycle from information governance to production, including the various technologies and strategies employed in the process.
  • Demonstrated ability to confer with government agencies or opposing parties with respect to eDiscovery matters.
  • Knowledgeable of privacy and cross-border issues.
  • Experience counseling on data transfer issues for eDiscovery in compliance with International Privacy regulations.
  • Experience with Second Requests and Complex High Stakes Litigations.
  • Ability to work on multiple projects simultaneously.
  • Ability to present information to partners, clients, and adverse parties clearly and concisely.
  • Ability to work under pressure and meet deadlines without supervision.
  • Demonstrated ability to manage stakeholders at all levels and handle competing demands and deadlines.
  • Commitment to high standards of quality.
  • Strong legal analysis and project management skills.
  • Strong written and oral communication skills.
  • Barred in the state of their office or eligible to sit for the bar exam.
  • Analytical, technical, flexible, versatile, and self-motivated.

Position Details:
This is a full-time, benefits eligible (day 1), exempt level position. Final rate of pay will be commensurate with the incumbent's experience, with a targeted hiring range of $175,000 – 225,000 per year. This position may be based out of our New York City, Washington DC, or Hartford, CT locations.
