We have a significant amount of real estate work and are currently seeking to hire a full-time attorney dedicated to this practice. This attorney would be responsible for handling all facets of our real estate practice and working closely with our sister title company, Nest Title & Escrow.Core Values:

The Right Fit For This Position
To excel as a Real Estate Attorney within our firm, the ideal candidate should demonstrate a robust set of skills and experiences, which include:
Extensive Experience:
Minimum of five years of focused practice in real estate law, with experience handling a variety of real estate transactions.
Real Estate Transactions:
- Expertise in conducting thorough title searches to identify any potential issues that could affect transactions.
- Proven ability to oversee the entire process of residential and commercial real estate closings, ensuring all legal, financial, and regulatory requirements are met.
- Competence in managing real estate financing arrangements, including negotiating terms and handling the documentation required for mortgage agreements and other financing instruments.
Legal Compliance and Complex Disputes:
- Thorough understanding of regulatory compliance issues related to real estate, including federal and state laws that govern transactions and property ownership.
- Skilled in navigating landlord/tenant laws, including lease negotiations, evictions, and tenant rights.
- Proficiency in zoning laws and regulations, which includes representing clients in hearings and ensuring compliance with local planning standards.
Real Estate Development:
- Understanding the legal requirements for property development, including land acquisition, construction contracts, development agreements, and the permitting process.
- Familiarity with environmental regulations and the impact of environmental assessments on property development.
Commercial Leasing:
- Extensive knowledge of drafting, negotiating, and interpreting commercial leases.
- Experience with issues specific to retail, office, and industrial spaces, such as tenant improvements, subletting, and leasehold financing.
Real Estate Litigation:
- Ability to represent clients in disputes related to property rights, boundary issues, easements, and contract disagreements.
- Experience with foreclosure processes, including both judicial and non-judicial foreclosures, and defending against or prosecuting breach of contract claims.
- Experience with quiet title actions to confirm ownership, resolve title disputes, and clear defects.
Land Use and Planning:
- Expertise in land use planning and negotiations with local government bodies regarding zoning variances, rezoning applications, and special use permits.
- Knowledge of historical preservation laws and their impact on property modifications and usage.
Condominium and Homeowners Association (HOA) Law:
- Experience in condominium and planned community development and governance.
- Ability to handle legal issues related to HOA disputes, governance, and compliance with state laws and regulations.
Tax Law Understanding:
- Basic understanding of tax law implications on real estate transfers to provide clients with strategic advice on minimizing tax liabilities during transactions.
- Knowledgeable in handling 1031 tax-deferred exchanges, allowing clients to defer capital gains taxes on property swaps.
Interpersonal and Communication Skills:
- Outgoing and engaging personality, capable of building strong, trusting relationships with clients.
- Excellent verbal and written communication skills, essential for explaining complex legal issues in an accessible manner to clients and in negotiations.
