Description:
We are seeking a Privacy Counsel to support our fast-growth, international, high-tech energy company.The Privacy Counsel will be responsible for providing legal support to Enphase's technically-diverse and multi-jurisdictional organization. Working directly with our head of privacy and security in the legal team, you will have the opportunity to shape our privacy posture and engage with a cross-disciplinary and multi-jurisdictional team. You will be working with colleagues around the world on a daily basis, touching on an array of different privacy regulations, products, technologies, and issues.
Qualified Candidates will have the opportunity to:
- Support privacy needs worldwide, including the role of personal information in hardware, software, and SAAS products, sales agreements, digital marketing, development partnerships, and HR
- Improve our privacy program based on rapidly evolving privacy regulations worldwide, including all US states, GDPR, LPGD, PIPL, India's long-anticipated privacy bill, Australia's Privacy Act, and more
- Perform M&A privacy due diligence and integration activities, including drafting and modifying privacy policies, maintaining data map, and working with business teams to improve business processes and product features
- Maintain internal privacy program materials, including data maps, risk assessments, transfer impact assessments, and compliance memos
- Develop a privacy training program customized for our diverse teams: product, digital marketing, software, hardware, SAAS, and other teams
- Maintain template materials including: DPA, data sharing provisions in sales and partner agreements, template responses to data subject requests, and M&A diligence and integration checklists
- Improve and manage data subject response process
- Support the security team on the frequent overlap of privacy and cyber-security, including internal and external security needs arising from privacy laws, and long-term initiatives such as data retention/destruction policies, incident response plans, and security audits
- Actively engage with the entire Legal team to develop, implement, and enforce legal and compliance policies
- Work cross-functionally within the company to influence and create actionable initiatives and reduce legal risk
- Assisting in other matters as may be requested
The Ideal Candidate has the following education and experience.
- JD or LLM from a nationally recognized ABA accredited law school
- Member in good standing of a US State Bar
- 5 - 8 years experience as a lawyer, preferably with in-house experience
- 2+ years experience working with domestic and international privacy laws, including at least CCPA and GDPR
- Experience in high-tech, including hardware, software, and SAAS products (preferred)
- CIPP/US and CIPP/E certifications (preferred)
- Be an independently motivated self-starter to identify needs and propose strategies
- Excellent organizational and time-management skills in order to thrive in a fast-paced and busy environment
- Strong verbal/written communication skills with an ability to communicate at all levels of the organization
- Ability to be flexible, think strategically, and exercise judgment to balance legal risks against business needs
- Possess high integrity and ethics
- Ability to collaborate cross-functionally and build enduring relationships
- Passion to accelerate the move to a better world through clean energy
