Responsibilities of An Attorney III:
We are looking for a highly qualified and experienced attorney who is passionate about public service and who shares our core values: embracing service, inspiring innovation, promoting teamwork, pursuing excellence, and advancing equity.

If hired, you will:
  • Work under supervision of the Chief Counsel for Healthcare Quality and the agency's General Counsel, providing legal advice and counsel to the agency's Director, the Deputy Director of Healthcare Quality, and the Healthcare Quality programs.
  • Work closely with program directors and staff engaged in regulatory activities involving healthcare facilities and other licensed facilities and providers.
  • Assist with the promulgation of regulations;
  • Conduct complex legal research and draft legal opinions and memoranda;
  • Represent the agency and its Healthcare Quality programs in meetings and negotiations and in responding to inquiries from the public, the regulated community, and opposing legal counsel;
  • Review and advise Healthcare Quality programs on changes in statutory law, regulations, significant case law, or agency policy;
  • Draft, review, revise, and ensure the accuracy and proper content, form, and grammar of legal documents related to Healthcare Quality programs. Review and work with program staff on revisions of documents prepared by staff to ensure legal accuracy and sufficiency and proper content, form, and grammar; and
  • Represent the agency and its Healthcare Quality programs in litigation before the Administrative Law Court and other state and federal courts. Representation includes but is not limited to: drafting pleadings, motions, briefs, and other litigation documents; conducting and responding to discovery requests; taking and defending depositions; managing exhibits; preparing witnesses; presenting oral arguments; conducting trials; and settling actions.

Minimum and Additional Requirements:
State Minimum Requirements:
A juris doctor degree or its equivalent from an accredited law school and experience as a practicing attorney.

Institutions of Higher Learning must be recognized by the Council for Higher Education Accreditation.

Agency Additional Requirements:
To qualify as a candidate for this position, you must:
  • Have at least six (6) years' experience as a practicing attorney (which may include judicial clerkships);
  • Possess a Juris Doctor degree from an ABA-accredited law school;
  • Be a member in good standing of the South Carolina Bar;
  • Possess and maintain a valid driver's license; and
  • Have completed trial experiences as required by Rule 403, S.C. Appellate Court Rules.

  • Possess a strong work ethic and the ability to work independently with minimal supervision;
  • Possess a strong working knowledge of the laws of South Carolina, with the ability to interpret and apply state and federal laws, regulations, and judicial decisions;
  • Possess excellent legal research and communication skills, with the ability to explain legal issues in simple, direct, and easily understandable terms;
  • Possess strong interpersonal skills, with the ability to work in a team environment and interact professionally and collaboratively with all levels of internal staff, courts, opposing counsel, government agencies, entities, and the public;
  • Demonstrate strong legal writing skills (A legal writing sample must be submitted with your application);
  • Possess strong organizational skills; and
  • Possess a commitment to professionalism, ethics, and public service.

Preferred Qualifications:
The following qualifications are preferred, but not required:
  • Experience practicing regulatory and administrative law;
  • At least two years' experience in litigation;
  • Experience practicing health care law;
  • Experience appearing before the South Carolina Administrative Law Court;
  • Experience practicing before the S.C. Circuit Court;
  • Experience with state appellate practice; and
  • Experience with the state process for regulation promulgation.
