Overview:
The General Assistant Employment Litigation Counsel will defend the Company and supervise outside counsel in all employment-related litigation matters enterprise-wide (US and Canada), including single plaintiff and collective and class action lawsuits involving discrimination, retaliation, wage and hour, wrongful termination, employment-related tort, restrictive covenants/unfair competition/trade secrets, employment benefits, and whistleblower. Responsible for the defense of the Company in commercial litigation matters including claims of Title III ADA public accommodation, customer escalation matters, including discrimination claims by customers. Investigate, develop strategy, respond to, and represent the Company in all phases of proceedings before administrative agencies including charges of discrimination and other complaints filed with federal, state and local EEO agencies, OSHA, NLRB as well as complaints filed with federal and state departments of labor regarding minimum wage, overtime, child labor and waiting time penalties. Investigate and respond to pre-litigation employment and customer related demands, internal escalations, and claims made by current or former employees and/or customers. Comprehensive service as a strategic business partner to the ODP enterprise and its multi-faceted businesses (retail, ecommerce, B2B, technology services) in order to mitigate risk and prevent litigation.

Primary Responsibilities:
  • Defend the Company and supervise outside counsel in all employment-related litigation matters in the U.S., Canada, Puerto Rico and USVI, including single plaintiff and collective and class action lawsuits, mediations, and arbitrations involving discrimination, retaliation, wage and hour, wrongful termination, employment-related tort, restrictive covenants/unfair competition/trade secrets, employment benefits, whistleblower, and any other employment-related claims. This includes developing litigation strategy, reviewing and revising pleadings, documents, depositions, discovery requests and responses, attending witness interviews, depositions, mediations, hearings and trials, reviewing and approving outside counsel bills, fees and budgets, evaluating and making recommendations regarding settlement and settlement amount.
  • Defend the Company and supervise outside counsel in commercial litigation matters including without limitation claims of Title III ADA public accommodation, customer discrimination.
  • Investigate, develop strategy, respond to, and represent the Company in all phases of proceedings before administrative agencies including charges of discrimination and other complaints filed with federal, state and local EEO agencies, OSHA, NLRB as well as complaints filed with federal and state departments of labor regarding minimum wage, overtime, child labor and waiting time penalties.
  • Investigate and respond to pre-litigation employment and customer related claims, internal escalations, and demands made by current or former employees or customers.
  • Provide strategic advice to the Company on employment-related matters to comply with new laws, court decisions or to respond to employment issues or opportunities for improvement in the organization and as a preventative litigation measure and risk mitigation.
  • Provide strategic advice, counseling and training in order to mitigate risks to the Company regarding a variety of issues, including discipline and termination, discrimination and retaliation, wage and hour, and restrictive covenants.
  • Responsible for reviewing and responding to third-party subpoenas.

Education and Experience:
  • Master's degree or equivalent experience in Law (J.D.)
  • Minimum 8-10 years of experience in related field
  • Law firm specializing in employment litigation and in-house experience preferred
  • Extensive experience leading all facets of employment litigation
  • State Bar License
  • Computer proficient
  • In-depth knowledge of federal and state labor and employment laws and regulations
  • Strong communication skills
