Job Description and Duties:Join the mission-driven team at the Department of Toxic Substances Control (DTSC) as we safeguard California's health and environment. As part of the California Environmental Protection Agency (Cal/EPA), DTSC is dedicated to regulating hazardous waste and overseeing the safe handling, treatment, and disposal of toxic substances statewide. In this role, you'll play a crucial part in ensuring compliance with legal requirements and supporting our efforts to restore contaminated lands. As an Attorney you will have the opportunity to:
- Provide legal support on legal matters related to the department's various fees, including Activity Fees, Generator and Disposal Fees, Environmental Fees, EPA Identification Verification Fees, Facility Fees, and Manifest User and Correction Fees
- Advise department management and staff on statutory and regulatory requirements governing hazardous waste management and collection of fees
- Research and prepare memoranda on interpretation and implementation of statutes and regulations enforced or administered by the department
- Represent the department in fee appeals
- Prepare legal briefs and/or work with California Department Tax and Fee Administration (CDTFA) attorneys to prepare joint legal briefs on fee appeal matters
- Represent the department at CDTFA Appeals Conference Hearings and CDFTA Board Member Hearings
- Represents DTSC in administrative proceedings to enforce administrative cleanup orders, fee appeals and other administrative litigation
- Strong legal writing skills
- Ability to conduct sound legal research and statutory analysis
- Understanding of the California State statutory laws and provisions of the State Constitution
- Knowledge of legal principles and application
- Knowledge of Bankruptcy, Collections, and/or Estate Planning laws
- Experience in administrative or civil litigation in State and Federal Courts
- Understanding of environmental laws, such as CERCLA, RCRA, HSM and HWCL
- Knowledge of public records requirements
