Overview:
The Real Estate Counsel II supports the Deputy General Counsel - Real Estate by providing real estate legal team support, which entails primarily, the reviewing, drafting and negotiating real estate leases, contracts, and other critical real estate documents. The Real Estate Counsel II interacts with individuals at all levels of the business and outside legal counsel.

Position reports into our Store Support Office in Phoenix, AZ.

Overview of Responsibilities
  • Draft, review and negotiate sophisticated real estate leases, amendments, letter of intents, construction documents, REA documents, SNDAs, estoppels, contracts and other ancillary real estate documents required to leases for new and existing stores
  • Manage, follow-up, and resolve all post-execution lease matters
  • Responsible for maintaining and updating Master Inserts for Leases and LOIs
  • Performs assignments and projects as needed to facilitate and assist with achieving overall company goals
  • Define and breakdown complex legal issues, identify and evaluate legal risks, recommend a course of action, and develop solutions and solve problems related to the Company's real estate portfolio
  • Review and analyze business and legal issues and disputes, and negotiate acceptable solutions and compromises, involving internal departments, governmental agencies and other third parties
  • Investigate, research, and prepare responses to demand letters from individuals and opposing counsel
  • Conduct detailed research and analysis on complex legal issues that have significant impact to the business
  • Work with outside counsel who have been assigned responsibility to handle legal matters on behalf of the Company.
  • Cooperating and collaborating with other functional areas of the business such as construction; facilities management; operations, lease administration; insurance; procurement; and legal and regulatory compliance
  • Interact effectively and efficiently with any opposing parties as needed
  • Communicate and effectively partner with internal departments and senior leaders and represent the team in a helpful and professional manner
  • Perform other duties as assigned by the Deputy General Counsel - Real Estate

Qualifications:
  • Minimum 8-10 years of experience as a real estate attorney. In-house corporate real estate and/or law firm real estate experience required
    • JD from an ABA accredited law school
    • Self-starter, independent worker with a high level of creativity, and an ability to creatively solve problems with a variety of variables
  • Good understanding of various legal processes
  • Ability to read, analyze and interpret general business periodicals, professional journals, technical procedures, some financial reports, legal documents or governmental regulations
  • Strong verbal and written communication skills are essential. In addition, the ability to effectively speak and present to large groups
  • Strong project management skills with the ability to create and implement efficient execution strategies and methodologies appropriate for a retail services environment
  • Ability to interface successfully with all levels of management within the Company and with outside legal professionals
  • Must enjoy helping people, working in a fast-paced high volume environment and have a patient, respectful and tactful manner
  • An outstanding eye for detail with a drive to provide exceptional support to the real estate team.
