Job Overview:
Experienced litigator and counselor will support MBUSA's legal department and business units to deliver consistent strategic advocacy, risk mitigation, and optimal resolution of labor & employment; brand protection; products liability; class action; warranty; dealer relations; and other disputes in the United States.

  • Provide business units various counselling and advice to reduce litigation risk on topics ranging from HR practices to marketing and technical literature.
  • Manage the company's varied litigation portfolio, including responding to pre-litigation demands, administrative charges, and law suits.
  • Manage various litigation as needed, including HR/employment, intellectual property, products liability, class action, warranty, dealer relations, and commercial disputes.
  • Where appropriate, manage and resolve disputes and litigation without incurring expense of retaining outside counsel.
  • Strategically engage and manage outside counsel where necessary.
  • For litigated matters, provide strategic counsel on significant court pleadings and briefs and risk assessment; minimize business disruption caused by litigation; coordinate accurate discovery responses; prepare and identify appropriate corporate witnesses for deposition and trial; appear in court; control outside counsel expenses; and coordinate litigation strategy with other Legal Department colleagues.
  • Support and enforce trademark and other intellectual property rights of Mercedes-Benz Group via trademark enforcement program Develop and conduct in-house training seminars for key business units on legal topics.
  • Ensure MBUSA departments are properly informed of legal issues relating to their activities by consultation, communication and maintenance of sufficient familiarity of antitrust, employment, franchise, contract, construction, tort, lemon law, warranty, environmental, consumer protection and product liability laws.
  • Develop proactive strategies to avoid potential legal claims and create processes for the cost-effective and strategic evaluation of pre-litigation and litigated disputes.
  • Create measures to control cost, comply with annual operating budget, and review and approve outside counsel costs.
  • Supervise paralegal(s) to support litigation-related work.
  • Respond to and produce documents responsive to subpoenas and search warrants.
  • Effectively guide and lead interdisciplinary and/or international working groups and teams.
  • Work effectively with product, technical, and other experts to advance litigation strategy.

  • Law degree from accredited law school
  • Licensed attorney (preferably in Georgia) in good standing
  • At least 7 to 10 years of litigation and business counseling experience in the areas of labor and employment, complex business, product liability, design defect, warranty and/or consumer protection litigation
  • Effective and persuasive oral and written communication skills
  • Strong interpersonal, writing and presentation skills, along with the ability to communicate effectively with others at all levels of the organization

  • Strong attention to detail with above-average multi-tasking skills and the ability to adapt quickly to situations that require immediate transition
  • Ability to travel on a monthly/quarterly basis to represent the company's interests at trial and other significant litigation events; ability to work in person on a "hybrid" or other schedule as determined by corporate policy and business need
  • Ability to leverage office technology, software, and databases to manage workflow efficiently and collaborate with other stakeholders
