Job Summary:This position is responsible for presiding over Fort Mill Municipal Court duties. Serves as Chief Municipal Judge. Oversees duties of part-time Associate Judges
Major Duties:
- Performs Municipal Court judge duties for offenses occurring within the Town limits, i.e., issue arrest, bench, and search/seizure warrants on defendants for Municipal and General Sessions court, ensuring probable cause is met.
- Prepares and executes arrest warrants, bond paperwork and handling of bond hearings. Responsible for having general availability, while on duty, to execute search warrants and emergency search warrants, as needed.
- Coordinate with Associate Judges for on-duty scheduling, and ensuring all serving judges are complying with applicable training, quarterly summary court meetings, and CLE requirements.
- Act as a liaison, and representative, on behalf of the Fort Mill Municipal Court to the Town of Fort Mill, Town Council and the Fort Mill Police Department. This includes serving in an advisory capacity for Town Council and Fort Mill Police Department in regard to criminal law/ procedure as it pertains to the operation of the Municipal Court.
Knowledge Required by the Position
Pertinent Federal, State, and local laws, codes, regulations, and court decisions relating to Municipal Court jurisdictions. • Judicial procedure and rules of evidence as well as the organization, duties, powers, limitations, and authority of the Municipal Court. • Operations, services and activities of basic court procedures and judicial ethics. • Operations, services, and activities of the Town. • Principles and practices of budget development, administration, and accountability including funding sources impacting program and service development.
Supervisory and Management Responsibility
Oversees duties of part-time Associate Judges
Minimum Qualifications:
A Juris Doctorate Degree is required. • Over 10 years of experience as a trial attorney with an emphasis in criminal law. • Substantial litigation, criminal law enforcement, and jury trial experience. • Must have at least 6 years of responsible supervisory and administrative experience. • Active member of the York Bar and Law License.
